GENERAL CONTRACTUAL TERMS AND CONDITIONS FOR ONLINE STORES

www.37lovers.com or www.37lovers.es (hereinafter, the Website) is a website owned by Mónica Rucabado, hereinafter THE OWNER, with CIF/NIF nº: 07246136D and registered office at: Avda. Luis García Cereceda, 7, 28223 - Pozuelo, Madrid.

Access, reproduction and use of the Web services requires prior acceptance of the Terms of Use in force at any given time; THE OWNER reserves the right to modify said Terms when it deems appropriate, by publishing the new text on the Web.

It is the user's responsibility to be aware of the Terms of Use before accessing the products and services on the Website; if you do not agree with them, please refrain from using it.

PROPERTY

The Web is a work composed of various integrated and inseparable elements (text, illustrations, photographs, animated images, videos, computer programs, including the website's html code, etc.), whose Intellectual Property belongs to THE OWNER, except for those materials obtained under license from third parties.


The OWNER and its licensors retain at all times the Intellectual Property rights to the Website and its individual components, in all copies made (regardless of the medium), granting only the usage rights described below. Any rights not expressly granted are reserved.


In addition to the above, THE OWNER is responsible for the selection, design of the structure and arrangement of the content of the Web, as well as being the one who has taken the initiative and assumed the risk of making the substantial investments aimed at obtaining, digitizing and presenting it, and is therefore entitled to the protection that Article 12 and Title VIII of Book II of the Intellectual Property Law may grant on the website, considered as a database.


The OWNER is also the sole owner of the design and graphic image of the Website, reserving the right to take appropriate legal action against persons who make imitations or unfair uses thereof.

It is permitted:

  • Web browsing, that is, accessing and viewing the website on a device, is permitted, and any temporary or incidental reproduction is authorized, provided that such reproduction is not intentional and forms an integral and essential part of the technological transmission process.   • Operations and activities expressly prohibited in any other sections of these General Conditions and, in general, any that may harm the normal functioning of the Website, other users or any third party.

Links and hyperlinks to this website from other pages or websites are permitted, provided they are not done in a way that harms the public image and brand of THE OWNER, the website, or any of the people and products referenced therein. The use of techniques that could create confusion about the identity and ownership of the content, such as framing or others, is expressly prohibited when establishing links to this website.

The OWNER will have full freedom to decide whether the collaborations and messages are finally published on the Web or not, and will be entitled to remove them when deemed appropriate.


Violation of any of the rules contained in these Terms of Use and especially those provided for in this clause, will entitle THE OWNER to immediately terminate your registration as a user or subscriber of the Website.

PAYMENT METHODS

We also accept payments through the main systems offered by Shopify.

DELIVERY TIMES

Order delivery takes between 2-6 days. We'll tell you about the process from the moment you place your order.
1. The warehouse confirms the order (usually within 24 hours)
2. The next working day, the courier picks up the order from the warehouse.
3. The next day your order will be on its way to your home. *Please note that Saturdays, Sundays, and public holidays are not considered working days.
Occasionally, orders may be delayed by 1 or 2 days, as our service depends on a chain of people involved in the warehouse, the courier service, and our own management. We promise to take care of your order so that it arrives as quickly as possible.

IMPORTANT! Please check your order as soon as possible and make sure everything is correct.

If you're not home at the time of delivery, don't worry. The courier will try to call you to arrange a new delivery. If they can't reach you on the phone number you provided, they will leave a delivery attempt notice on your door or in your mailbox. Simply follow the instructions on the notice, and you can arrange a new delivery with the courier the following day. If you notice any delay in the delivery of your order, please don't hesitate to contact us at atencioncliente@almaenpena.es.
If none of the above situations apply, this absence will be reported to us as an incident, and the website will attempt to contact you within the next 24 business hours to arrange a new delivery. This redelivery attempt can be made up to two times, free of charge. If we do not receive a response within this timeframe, your order will be returned to the originating warehouse, and we will refund the amount of your order to your card.

RETURNS AND WITHDRAWAL

Consumers who place orders online have the protections recognized by European online purchasing regulations.

You can cancel your online purchase within 14 days of receiving the product. To exercise your right, download this form , fill it out, and send it to info@37lovers.com by email, or to Avda. Luis García Cereceda, 7, 28223 Pozuelo de Alarcón, Madrid, by regular mail.

To make changes to orders, you must follow the following process:

  1. You have a maximum of 14 days from the delivery of the order to make the return.
    2. You must send an email to info@37lovers.com with the following details:
    - Order numbers (appear in the emails they send you when you make the purchase).
    - Indicate the product you wish to return, if there are several in the order.
    - Reason for the change
  2. Put the product back in its original box and wrap it before the carrier picks it up.

We offer two systems for your possible returns:
- Situation 1. If you are not 100% satisfied with your purchase.
For just €6 per item (VAT included), we'll send you a label so you can drop off the package at your nearest post office. Once we receive the package at our warehouse, we'll refund the price of the returned item minus the return shipping costs.
- Situation 2. Shipping error or product quality issues. If this is your case, it is essential that you send an email with photos of the defect or problem with the shoe to info@37lovers.com. In this case, the return will not incur any costs, and the customer can decide whether to receive the correct product or cancel their order and receive a 100% refund.

The refund, minus any applicable shipping costs, will be processed once the package is received at our warehouse, within a maximum of 10 business days. The refund will be issued via the same payment method used by the customer for the initial transaction.

In case of cancellation, the refund will be made through the same payment method used by the customer for the initial transaction. and never after 14 calendar days after the consumer expresses his desire to exercise the right of withdrawal in accordance with article 107.1 RDL1/2007.

We will not issue a refund if the product has been used.

MODIFICATIONS

The OWNER reserves the right to make, without prior notice, any modifications it deems appropriate to the Website, and may change, delete or add both the content and services provided through it, as well as the way in which they are presented or located.


Although the OWNER will make every effort to keep the information on the Website up-to-date and error-free, no guarantee is offered regarding its accuracy or timeliness. Nor is the achievement of any specific result or purpose guaranteed; therefore, access to and use of the Website is the sole responsibility of the users and clients.

LEGAL ACTIONS

The OWNER will pursue any breach of these Terms of Use, as well as any misuse of the Website or its contents, infringements of the rights belonging to it or its licensors, especially those of Intellectual and Industrial Property, by exercising all the actions, civil and criminal, that may correspond to it under the Law.

SPECIFIC CONTRACTUAL CONDITIONS

General provisions

37LOVERS offers its customers (hereinafter, the “Customers”) various methods for purchasing goods and/or services offered by 37LOVERS on its website remotely, the characteristics and prices of which are duly identified on said website. These “Specific Terms and Conditions of Sale” will apply to sales formalized between Customers and 37LOVERS through telephone sales in their different forms (if any).

Likewise, the pre-contractual and contractual relationship resulting from purchases made through the Telephone Sales Modality will be governed by 37LOVERS, except in those terms where there is a contradiction with these Special Contract Conditions, in which case the provisions of this document will prevail.

These Special Contractual Conditions, as well as the General Contractual Conditions, are governed by the provisions of Law 34/2002, on Information Society Services and Electronic Commerce; Law 7/1998, on General Contractual Conditions; Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws; Law 3/2014 of March 27, which modifies the consolidated text of the aforementioned General Law for the Defense of Consumers and Users and other complementary laws, and any other legally applicable regulations.

Telephone hiring procedure

To acquire or purchase 37LOVERS products and/or services through the Telephone Sales Methods, the Customer must follow the instructions shown below:

  • In any case, the acquisition of products and/or services from 37LOVERS through the Telephone Sales Modalities will be available, exclusively, with respect to those goods and/or services that, at the discretion of 37LOVERS, allow this purchase method.
  • During the purchase process using the Telephone Sales Methods, the Customer must provide 37LOVERS, at least, with the following personal data: their name and surname, postal address, email address and mobile phone number.
  • If the desired product and/or service is not available in the store where the corresponding order is being processed, or if there are not enough units, 37LOVERS may offer the Customer different alternatives, redirecting them to other stores (including the 37LOVERS online store) if possible, or offering products and/or services with similar characteristics.
  • After providing the aforementioned information, the Customer will receive an email at the address they have expressly indicated to 37LOVERS. This email will contain the Customer's order details and will request their written acceptance of the following: (i) that they agree with the order details, (ii) that they agree that placing the order implies a payment obligation for the Customer; and (iii) that they have read and accept the Specific Terms and Conditions for Telephone Sales and the General Terms and Conditions of 37LOVERS, which govern the aforementioned purchase transaction, as well as the 37LOVERS Privacy Policy ( https://37lovers.myshopify.com/pages/politica-de-privacidad ).
  • Payment for the price of the products and/or services purchased and the shipping costs can be made by credit card, debit card or through other payment methods that 37LOVERS may offer to the Customer from time to time.
  • If the Customer has any questions about their order and its status, they can contact 37LOVERS via email.

37LOVERS will provide the most up-to-date information possible regarding the availability and stock of the items requested by the Customer. However, it is possible that a product whose availability has been confirmed may become unavailable during the purchase process itself (including any time the Customer may take to make and complete the corresponding payment, such as in cases of payment by bank transfer or financing) or that delivery times may be delayed due to special discount days, natural or environmental causes, strikes beyond 37LOVERS' control, and/or force majeure events beyond 37LOVERS' control.

In the event of such situations, 37LOVERS will do its best to inform the Customer by telephone.
